Judge allows selenium lawsuit against W.Va. coal operator to proceed

A federal judge has allowed an environmental group's lawsuit to proceed against a West Virginia mine operator over accusations of water quality violations.
The Charleston Gazette reports the plaintiffs submitted company discharge reports showing multiple violations of selenium water quality standards at several operations. Chambers said he would consider later whether Fola will be required to correct the problem.
Studies have found selenium, a naturally occurring element, can be harmful to aquatic life, and to humans with high-level exposure.
