A former Raleigh County sheriff's deputy accused of child battery is facing new charges.
The indictment charges that Burgess broke into a Raleigh County Sheriff's Department cruiser and stole gas credit cards. He's accused of using the credit cards for himself.
Raleigh County prosecutor Kristen Keller tells The Register-Herald that Burgess resigned in July. He had been suspended after he was charged in January with felony child battery.
An arraignment on the new charges is scheduled this week in Raleigh County Circuit Court.
