The West Virginia Supreme Court has upheld the kidnapping conviction of a Dunbar man who targeted an elderly man in a grocery store parking lot.
Jacobs testified that Mullins jumped into his car in January 2011 as Jacobs pulled into a parking lot. Mullins asked for money and then was told to drive to his home and later to a bank.
Mullins contended the money was a loan he intended to repay.
Jacobs was found dead the day after testifying. Prosecutors say the death didn't appear to be suspicious.
Mullins appealed the conviction, claiming a lack of evidence.
